Things to know after a vehicle mishap

Accidents can happen at the most unexpected times- there’s no way to predict them. Even those who are vigilant, careful drivers are still at risk of encountering a car collision. Unforeseeable factors can contribute, such as:

  • Reckless drivers
  • Learner’s
  • Under the influence
  • Series of unfortunate events

There are many more factors that can contribute, but most drivers would find themselves involved in one fender bender in their lifetime.

Remove Hazards

Stop your car and move into a safe area. Remember to place your hazard lights on to avoid any passing vehicles from getting injured. Without hazard lights, you can risk involving more people in the accident. Also, it is recommended to check whether the other driver needs medical attention and assess any damaged caused.

Assess the situation

Next, you will need to assess the situation to see whether police or medical attendance is needed. It is not compulsory for police attendance at a car mishap unless:

  • Anyone is trapped, injured or killed
  • Anyone involved failed to exchange details
  • Any of the drivers appear to be under the influence of drugs or alcohol

AND

  • Police are needed to direct traffic or hazards
  • A bus or truck needs towing
  • There are hazards present- leaking fluids, broken power poles, etc…
  • Issues requiring police assistance- violence, criminal behaviour, etc…

If emergency services are not needed

When exchanging details with the driver at fault remember to get as many details as possible:

  • Driver’s licence
  • Licence Plate Details
  • Phone Number
  • Insurance Details

It’s a good idea to lodge a police report within 24 hours of the vehicle accident. You can do this by calling the non-emergency number on 131 444.

Let your insurer know

Even though you are not at fault it is recommended that you give your insurer a call to let them know what is happening. Explain the accident and all the details of the other party.

You may also need to notify your relevant compulsory third party provider depending on which state you’re in.

What if I’m Injured

If you have been injured in a vehicle collision you may be able to claim for an injury entitlement. As long as the injuries were sustained in the in that mentioned incident. You may need to prove that the other driver was responsible.

Usually, when you make a claim, it is processed through their Compulsory Third Party Insurance. Worse case, there are some instances where the other driver is uninsured or not contactable the claim can be brought against the Nominal Defendant.

Nominal defendant

This is a scheme set up where someone can claim entitlements for their injuries if it was caused by an unregistered or unidentifiable vehicle. This allows all those injured in a vehicle collision the right to claim injury compensation.
