Making a claim
Our work injury specialists understand that having an accident can make a lot of things complicated. Your income may be in jeopardy and it can be a scary time.
We’re here to help and offer you a no-obligation quote to assist you towards your recovery and claim.
Who is liable?
Your employer has an obligation to keep you reasonably safe and:
- carry out a risk assessment to identify potential hazards in the workplace
- eliminate any risks that can be eliminated
- provide safety equipment where necessary
- train staff on safe working practices.
If your employer didn’t do their job properly in keeping you safe as reasonably possible, then they may be liable for the pain, suffering and other factors that may have occurred.
If you think your employer has or hasn’t done something right, call us on 1800 106 107 for a no-obligation quote.
Will claiming for an accident put my job at risk?
With high wages at stake and the thought of not being able to work in their sector again, lots of employees suffer in silence.
First of all, you don’t need to worry about losing your job.
Many people that we speak to are reluctant to make a work injury compensation claim against their employer because they think it will put their job at risk.
If an employer were to treat you any differently or terminate your employment, it would be against the law. Fairwork doesn’t take things like this lightly, and if it were to happen, you would be entitled to take legal action against them.
How much compensation can I get?
Because every work accident is different, the level of compensation awarded will vary on a case by case basis.
Some of the main things a solicitor will consider when negotiating your compensation will include.
- Any time off work and lost earnings
- Any future lost earnings
- Any changes in your ability to work
- Care or support, even if given to you for free by family or friends
- Any adaptations you might need to your home or motor vehicle
- Travel and accommodation expenses
At this stage it is impossible to give you an accurate estimation of what you could receive however, you can make your own assessment online, without having to speak to a lawyer using our compensation calculator.
Risk-free claiming
When you make a claim with our panel solicitors if for some reason your case is not successful, because of our guarantee you will not be required to pay any legal costs.
If your case is successful the legal fees that you will have already agreed upon with your lawyer will be deducted from your compensation.
Its worth noting that the losing side will normally pay a large part of your legal costs.
